Terms of Service & Company Policies
The following Terms of Service, Acceptable Use Policy, Privacy Policy, and Refund Policy govern the use of services provided by Little Creek Hosting, a Little Creek Solutions company. By using our services, you agree to comply with these policies.

1. Terms of Service
These Terms of Service ("Agreement") govern the use of services provided by Little Creek Hosting ("Little Creek Hosting", "we", "our", or "us"). By purchasing or using any of our services, you agree to be bound by this Agreement.
1.1 Services Provided
We provide virtual private servers (VPS), shared web hosting, reseller hosting, and related internet services. Service features and limitations are described on the applicable product pages and order forms.
1.2 Customer Responsibilities
Customers are solely responsible for all content, software, applications, and data stored on or transmitted through their hosting account or virtual server. Customers must maintain accurate account information and protect the confidentiality of their account credentials.
1.3 Unmanaged VPS Services
Unless otherwise specified, VPS services are unmanaged. The customer is responsible for operating system updates, software installation, security, firewall management, backups, and general server administration.
1.4 Billing
Services are billed in advance according to the selected billing cycle. Payment is due on or before the invoice due date. Accounts with overdue balances may be suspended or terminated until payment is received.
1.5 Suspension and Termination
Little Creek Hosting reserves the right to suspend or terminate any account that violates these policies, engages in unlawful activity, threatens the stability of our infrastructure, or creates legal or operational risk for our company or our other customers.
1.6 Backups
Customers are solely responsible for maintaining backups of their data unless a separate backup service has been explicitly purchased. While we may perform backups for operational reasons, these backups are provided as a courtesy and are not guaranteed.
1.7 Limitation of Liability
Little Creek Hosting shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services. Our total liability shall not exceed the amount paid for the affected service during the three months immediately preceding the event giving rise to the claim.
2. Acceptable Use Policy (AUP)
Our services may only be used for lawful purposes. Activities that interfere with the operation of our network or violate applicable laws are strictly prohibited.
2.1 Prohibited Activities
- Sending unsolicited bulk email (spam).
- Hosting or distributing malware, viruses, or malicious code.
- Phishing, fraud, identity theft, or deceptive practices.
- Unauthorized access to systems or networks.
- Copyright infringement or distribution of pirated material.
- Hosting content that violates applicable local, state, or federal law.
- Launching or participating in denial-of-service attacks.
- Operating services intended to disrupt or harm other networks.
2.2 Resource Usage
Customers may not intentionally consume excessive CPU, memory, disk I/O, or network resources in a manner that negatively impacts other customers or the stability of the platform. We reserve the right to limit or suspend services that create unreasonable resource usage.
2.3 Reseller Responsibility
Reseller customers are responsible for the actions of their own end users. Violations committed by reseller clients may be treated as violations by the reseller account.
2.4 Law Enforcement
Little Creek Hosting will cooperate with lawful requests from law enforcement agencies and may disclose information as required by applicable law.
2.5 Outbound Email and Anti-Spam Policy
To protect the deliverability, reputation, and stability of Little Creek Hosting's shared network and mail infrastructure, all VPS and hosting accounts are subject to automated monitoring of outbound email activity. We measure this activity as the number of outbound connections initiated to remote mail servers (SMTP, SMTPS, and Submission ports) over a given time window, rather than by inspecting the content or exact count of individual messages.
Accounts that initiate an excessive number of outbound mail connections, as determined by our monitoring systems, may have outbound mail service automatically suspended without prior notice. This automated suspension is a protective measure intended to prevent harm to other customers sharing our network and mail relay resources, and applies only to outbound mail traffic. It does not affect web, DNS, SSH, or other services on the account unless a separate violation of Section 2.1 or 2.2 has also occurred.
A suspension issued under this section can typically be lifted once the underlying cause has been identified and resolved. Customers may contact support to request restoration of outbound mail service and to discuss the activity that triggered the suspension.
Customers who anticipate a legitimate need to send high volumes of outbound email — for example, a newsletter, transactional receipts, or an announcement to an opt-in mailing list — should contact support in advance to request a temporary limit exception. Requests should include the approximate number of recipients, the sending software or method being used, and confirmation that recipients have opted in and are able to opt out. Approved exceptions apply only for the stated purpose and time window.
Repeated or severe violations of this section, including any confirmed sending of unsolicited bulk email, remain subject to the broader suspension and termination provisions of Section 1.5 and Section 2.1.
2.6 Outbound Network Abuse Monitoring (SSH and Other Ports)
To protect the security and stability of Little Creek Hosting's shared network, all VPS and hosting accounts are subject to automated monitoring of outbound connection activity on ports commonly associated with unauthorized scanning or intrusion attempts, including SSH (port 22). We measure this activity as the volume of new outbound connections initiated from an account relative to normal activity across our network, rather than by inspecting the content of any traffic.
Accounts that initiate outbound connection activity consistent with scanning, brute-force attempts, or other unauthorized network abuse, as determined by our monitoring systems, may have the affected outbound port or service automatically suspended without prior notice. This automated suspension is a protective measure intended to prevent harm to other customers, our upstream providers, and third parties, and applies only to the specific port or service involved. It does not affect web, DNS, mail, or other services on the account unless a separate violation of Section 2.1 or 2.2 has also occurred.
A suspension issued under this section can typically be lifted once the underlying cause has been identified and resolved. Customers may contact support to request restoration of the affected service and to discuss the activity that triggered the suspension.
Customers who anticipate a legitimate need for high-volume outbound connections on monitored ports — for example, fleet-wide SSH automation, configuration management, or scheduled backups across multiple servers — should contact support in advance to request that the relevant IP address(es) be excluded from this monitoring.
Repeated or severe violations of this section, including confirmed compromise, scanning, or intrusion attempts originating from an account, remain subject to the broader suspension and termination provisions of Section 1.5 and Section 2.1.
3. Privacy Policy
3.1 Information We Collect
We collect information necessary to provide and maintain our services, including account registration information, billing information, contact information, support ticket history, and server usage data.
3.2 Use of Information
Information collected is used solely for the purposes of providing services, processing payments, preventing fraud, communicating with customers, and complying with legal obligations.
3.3 Information Sharing
We do not sell or rent customer personal information to third parties. Information may be shared with trusted service providers as necessary to deliver our services or when required by law.
3.4 Security
We employ reasonable administrative, technical, and physical safeguards to protect customer information. However, no method of electronic storage or transmission over the Internet can be guaranteed to be completely secure.
3.5 Cookies
Our website and client portal may use cookies and similar technologies to improve user experience, maintain login sessions, and analyze website usage.
4. Refund Policy
4.1 Shared Hosting and Reseller Hosting
Unless otherwise stated, new shared hosting and reseller hosting accounts may be eligible for a refund if canceled within the first thirty (30) days of service. Domain registration fees, software licenses, setup fees, and third-party products are non-refundable.
4.2 VPS Services
Due to the immediate allocation of computing resources and licensing costs, VPS services are generally non-refundable once provisioned unless otherwise required by law or specifically advertised as refundable.
4.3 Account Cancellations
Customers may cancel services through the client portal at any time. Cancellation requests stop future billing but do not automatically generate refunds for previously paid service periods.
4.4 Abuse of Refund Policy
Little Creek Hosting reserves the right to deny refund requests in cases involving abuse, fraud, repeated sign-ups for the purpose of obtaining promotional pricing, or violations of these Terms of Service or the Acceptable Use Policy.
5. Service Level Agreement (SLA)
5.1 Uptime Commitment
Little Creek Hosting strives to provide reliable and uninterrupted service. We guarantee 99.9% network uptime on a monthly basis for all hosted services covered by this Service Level Agreement.
Network uptime is defined as the ability of customer systems to send and receive data through the Little Creek Hosting network and infrastructure.
5.2 SLA Credits
If Little Creek Hosting fails to meet the 99.9% monthly uptime commitment, affected customers may request a service credit according to the following schedule:

Service credits are applied to future invoices only and have no cash value.
5.3 Credit Requests
To receive an SLA credit, customers must submit a support ticket within seven (7) days of the service interruption. Requests should include the affected service and the approximate date and time of the outage.
5.4 Exclusions
The uptime guarantee does not apply to interruptions resulting from:
- Scheduled maintenance.
- Emergency maintenance required to protect the stability or security of the network.
- Failures or outages caused by upstream providers, transit providers, carriers, datacenters, or third-party services.
- Customer actions, misconfigurations, or software issues.
- Operating system, application, firewall, or control panel issues within customer-managed services.
- Distributed denial-of-service (DDoS) attacks or other malicious activity directed at customer services.
- Service suspensions resulting from violations of these Terms of Service or the Acceptable Use Policy.
- Force majeure events including natural disasters, acts of government, labor disputes, or events beyond our reasonable control.
5.5 Scheduled Maintenance
Little Creek Hosting may periodically perform scheduled maintenance to maintain, upgrade, repair, or improve its infrastructure.
Whenever reasonably possible, notice of scheduled maintenance will be posted on the Announcements page at least twenty-four (24) hours before the maintenance window begins. For maintenance expected to have a significant impact on customer services, additional advance notice may be provided at our discretion.
Scheduled maintenance windows are excluded from uptime calculations and are not eligible for SLA credits.
5.6 Maximum Credit
Under no circumstances shall the total SLA credit issued for a service exceed the amount paid by the customer for that service during the affected billing period.
This Service Level Agreement provides the sole and exclusive remedy for any failure to meet the uptime commitment.
6. Changes to These Policies
Little Creek Hosting reserves the right to modify these Terms of Service and related policies at any time. Updated versions will be posted on this page. Continued use of our services after such changes become effective constitutes acceptance of the revised policies.
